Many borrowers feel completely helpless in front of banks, NBFCs and apps.
The truth is: you do have rights. They won’t solve every problem, but they’re real.
Let’s put them down in plain English.
(This is general information, not legal advice.)
You have a right to:
· see the key terms of a loan or card,
· know the interest rate, fees, and major conditions,
· get a copy of the agreement or a summary.
If you do not understand something, you can ask questions before signing.
You have the right to:
· access your own credit report from each bureau (sometimes free, sometimes paid),
· know what information is being used to judge your applications.
You do not have to depend only on what the lender says.
If something on your credit report is clearly wrong, you have the right to:
· raise a complaint with the lender,
· raise a dispute with the bureau,
· receive a response within a reasonable time.
They may not always agree with you, but they cannot ignore you.
Even if you are late:
· lenders and their agents cannot threaten, abuse or publicly shame you,
· they must follow RBI’s guidelines on hours and methods of contact.
You still owe money, but you don’t lose your basic dignity.
If a bank or certain NBFCs don’t respond properly, you can:
· escalate within the institution (nodal officer),
· approach the RBI Ombudsman for eligible entities and issues.
This takes effort and patience, but it exists as a safety valve.
· Thinking “bank can do whatever they want, we have no say”.
· Assuming complaining will automatically fix everything.
· Believing any strong behaviour by agents is “normal” and must be tolerated.
· Keep written records of major interactions and complaints.
· Read at least the key facts statement or summary before signing.
· If something feels off, ask for it in writing and take time to think.
· Use formal complaint channels before completely losing hope.
Borrowers in India are not powerless, but the system is complex and tiring.
Knowing your basic rights won’t guarantee perfect outcomes, but it’s the first step towards not being lost in every difficult conversation.
